Customers:

companies that subscribe to ENotary and the people on their team who use the platform.

Signers and witnesses:

people invited to a notarization session by a customer.

Visitors:

people who browse e-notary.com or create an account.

Notaries who perform acts on the platform process personal data as required by the law of their commissioning state. This policy covers what ENotary does with that data as the platform provider.

• Account data: work email, name, company name, role and login data.
• Billing data: plan, billing period and payment status. Card details are handled by our payment processor and are not stored by ENotary.
• Documents: files uploaded for notarization and the sealed documents produced in a session.
• Identity verification data: images of the signer's ID, a liveness selfie, results of credential analysis and knowledge-based authentication. Knowledge-based questions are generated by an identity verification provider from public and commercial records.
• Session data: the audio-video recording, the audit trail with timestamps, IP addresses and device data, and the notary's journal entry.
• Website data: pages visited, referrer, campaign parameters and technical data such as browser type, collected through essential cookies and server logs.
• Messages you send to [email protected].

• To provide the platform: run sessions, verify identity, apply seals and keep records.
• To meet legal duties: notarial records, recordings and journals must be kept as the notary's commissioning state requires.
• To secure the service: detect fraud, prevent unauthorized access and keep access logs.
• To bill customers and manage subscriptions.
• To answer questions and send service messages, such as sign-in codes and session notifications.
• To improve the website, using aggregated usage data.

We do not sell personal data. We do not use identity verification data or documents for marketing.

• The commissioned notary who performs the session, and the customer who created it.
• Service providers that help us run the platform: hosting, identity verification, video, email delivery and payment processing. They process data only on our instructions.
• Authorities, when the law requires it, for example a request from a notary regulator or a court order.
• A buyer or successor, if ENotary's business is transferred, under the same protections.

• Notarial records, audit trails, journal entries and recordings: for the retention period required by the notary's commissioning state, or longer if the customer sets a longer retention on Enterprise or a legal hold applies.
• Identity verification data: only as long as the notarial record requires.
• Account data: while the account is active and for a reasonable period after it closes, for billing and legal claims.
• Website logs: for a limited period, then deleted or aggregated.

Data is encrypted in transit and at rest. Access is limited by role and logged. Signer links are unique and expire. Read more on the notarization audit trail page.

Depending on where you live, you may have the right to access, correct or delete your personal data, to object to certain uses and to receive a copy of it. Some data, such as notarial records, must be kept by law and cannot be deleted before the retention period ends. Signers can direct requests about a session to the customer that invited them or to us. To make a request, write to [email protected].

We use essential cookies to keep you signed in, remember your choices and protect forms from abuse. We do not use advertising cookies.

ENotary is a business service and is not directed to children.

We update this policy when our practices change. The date at the top shows the latest version. For significant changes, we notify customers by email.
