Terms of service

ENotary provides a platform for remote online notarization: a session room, identity verification, digital sealing, audit trails and record storage. Notarial acts are performed by commissioned notaries, either from the ENotary network or employed by the customer, under the law of the notary's commissioning state. The notary alone decides whether to perform a notarial act and may refuse it when the law or professional judgment requires.

You must provide accurate account information and keep sign-in details secure. Customers are responsible for the activity of the people they add to their workspace. You must be authorized to bind your company to these terms.

• ENotary is sold as a subscription. Plans are billed monthly or yearly, in advance, at the prices shown on the pricing page when you subscribe.
• Subscriptions renew automatically at the end of each billing period until cancelled.
• You can cancel at any time. Your plan stays active until the end of the paid period and does not renew after that. Payments for a period that has started are not refunded, except where the law requires it.
• Moving to a higher plan applies right away, with the price prorated. Moving to a lower plan applies from the next billing period.
• Enterprise plans can be invoiced with net 30 terms under a separate order.
• Prices do not include taxes, which are added where applicable.

Each plan includes a number of network notary sessions per billing period. A session is one notarization meeting with up to 4 signers and up to 10 documents. The allowance refreshes at the start of each billing period and unused sessions do not carry over. Sessions performed by the customer's own notaries do not use the allowance. When a customer needs more network sessions, the customer moves to a higher plan.

• You upload only documents you have the right to send for notarization.
• You invite signers who agree to take part and who are the people named in the document.
• You check with the recipient of a document whether it accepts a remotely notarized document before relying on it.
• You do not use the platform for fraud, to impersonate anyone, to notarize a document you know to be false or to bypass identity verification.
• You do not try to access other customers' data, disrupt the platform or reverse engineer it.

Customers who add their own notaries confirm that each of them holds a valid commission that allows remote online notarization and follows the law of their commissioning state. The customer is responsible for its own notaries' acts.

Laws on remote online notarization and the practices of recipients differ between states, counties, courts, agencies and countries. ENotary does not guarantee that a particular recipient accepts a particular document. Information on the website and in the document check is general and is not legal advice.

Customers own their documents. ENotary stores notarial records, audit trails, journal entries and recordings for the retention period the law requires, and handles personal data as described in the privacy policy. When an account closes, records that must be kept by law remain stored until their retention period ends.

We work to keep the platform available and secure, and we may perform maintenance. We may update the platform and these terms. We notify customers of material changes to these terms by email before they take effect.

To the extent the law allows, the platform is provided as is, and ENotary is not liable for indirect or consequential damages. ENotary's total liability for any claim relating to the service is limited to the amount the customer paid for the service in the twelve months before the claim.

We may suspend or close an account that breaks these terms, fails to pay or puts signers, notaries or the platform at risk. Customers may close their account at any time by cancelling their subscription and writing to [email protected].
